Property Listing Service

  1. If you use the Placematch property listing service (Listing Service) then, in addition to the terms and conditions above, the following terms and conditions apply.
  2. In the following, "material" includes any text, photographs, floor plans or other material prepared and submitted by any third party service provider on your behalf.
  3. Placematch is not, and does not hold itself out to be:
    • an estate agent generally, or an "estate agent" as defined and contemplated in the Estate Agency Affairs Act, 1976, as amended, or any replacement legislation, in particular; or
    • an attorney, conveyancer, financial or tax advisor, mortgage bond originator, or valuer.
  4. Placematch has no power as agent or otherwise to negotiate or conclude any agreement on your behalf, and no such power must be inferred. You are liable for all obligations and consequences howsoever arising from your negotiation or conclusion of any agreement pursuant to the use of the Listing Service.
  5. You use the Listing Service at your own risk.
  6. When using the Listing Service you may not submit any material that:
    • is unlawful;
    • is harmful to minors;
    • is fraudulent, false or misleading;
    • infringes any third party intellectual property, personal, confidentiality, or other rights; or
    • is defamatory or obscene.
  7. You are solely responsible for all material that you submit and any consequences that may result from your submission.
  8. You grant Placematch a perpetual, royalty-free, transferable right to publish all material submitted by you.
  9. You must comply with all applicable laws, including (without limitation) the Consumer Protection Act, 2008 and the Alienation of Land Act, 1981.

User Profiles and Matching Service

  1. Placematch provides a matching service to connect people looking for properties with property owners and real estate professionals.
  2. Users may create profiles indicating their property preferences, budget, and other relevant information.
  3. Placematch uses this information to suggest potential matches, but does not guarantee successful matches or outcomes.
  4. Users are responsible for the accuracy of all information provided in their profiles.
  5. Placematch reserves the right to remove or suspend profiles that violate these terms or contain false information.
  6. All communications between users are the responsibility of the users themselves. Placematch is not liable for any disputes or issues arising from user interactions.
  7. By accepting contact requests or matches, users acknowledge and consent to sharing their contact information (including email address and phone number) with the requesting party. Users are responsible for ensuring they are comfortable with this information sharing before accepting any requests.

Disclaimer

  1. The website carries property advertisements, news, reviews and other content independently published by third parties on the website. The website is not involved in the buying, selling or development of the property process and must not be considered to be an agent, buyer and/or a developer with respect to the use of the website.
  2. Placematch shall not be responsible for any user entering into agreements or making decision whatever nature in connection with the posting of property ads, property information, personal owned property information, use of financial calculators and/or the contents thereof and/or any other information obtained on the website.
  3. Whilst Placematch has taken reasonable measures to ensure the integrity of the website and its contents, no warranty, whether express or implied, is given that the website will operate error-free or that any files, downloads or applications available via the website are free of viruses, trojans, bombs, time-locks or any other data, code or harmful mechanisms which has the ability to corrupt or affect the operation of your system.
  4. In no event shall Placematch, and/or any third party contributors of material to the website be liable for any costs, expenses, losses and damages of any nature (whether direct, indirect, punitive, incidental, special or consequential) arising out of or in any way connected with your use of the website, your inability to use the website and/or the operational failure of the website.

Applicable Law

This website is hosted, controlled and managed in the Republic of South Africa, and thus, South African law and jurisdiction govern the use or inability to use this website, or any other matter related to this website.

Disputes

All disputes in terms of this agreement or relating to the use or inability to use this web site shall be settled by arbitration conducted in English in terms of the rules of the South African Arbitration Foundation. Such arbitration shall be held in Cape Town, and the unsuccessful party shall pay all costs incurred by the successful party in attending and preparing for such arbitration.
